WASHINGTON (AP) ? The top Democrat in the Senate said Tuesday that lawmakers should redouble their efforts to replace looming across-the-board cuts to the Pentagon and domestic programs with alternative spending cuts and tax hikes.
The comments by Majority Leader Harry Reid came amid increasing resignation among both Democrats and Republicans that the across-the-board cuts will soon take effect. The cuts were an element of the so-called fiscal cliff that was partially averted this month with the extension of Bush-era tax cuts.
But the reprieve from spending cuts of 7 percent to the Pentagon and 5 percent to domestic programs was only temporary and will expire March 1. The cuts are known as sequestration in Washington-speak.
Republican controlling the House had led the battle to avert sequestration last year by passing replacement cuts, while Democrats put their faith in high-level budget talks involving President Barack Obama and House Speaker John Boehner, R-Ohio, ? which failed ? and in later, successful negotiations between Vice President Joe Biden and Senate Minority Leader Mitch McConnell, R-Ky.
But House Republicans now say that the across-the-board cuts provide incentive to Democrats to agree to a broader budget pact and they appear willing to let them take effect ? despite having issued dire warnings just last year of their impact on the Pentagon.
Reid said the cuts should be replaced "in short increments" with spending cuts and revenues like repealing oil and gas subsidies that were discussed in earlier negotiations.
"There are many low-hanging pieces of fruit out there that Republicans have said they agreed on previously," Reid said. There's a lot of things we can do out there, and we're going to make an effort to make sure that there is ? sequestration is ? involves revenue."
Republicans tend to represent states that have more at stake if the cuts take effects. Many GOP-dominated southern states, for instance, have major defense installations. And defense hawks warn that the cuts could cripple the military as problems fester around the world in places like Afghanistan, Iran and Syria.
"If you believe the Defense Department, (and Defense Secretary Leon) Panetta, we're destroying the finest military in the world at a time when we need it most," said Sen. Lindsey Graham, R-S.C. "I can't explain it. It is beyond my ability to explain it to people."

General Motors will add a third shift at its Gravata? Industrial Complex in the south of Brazil, resulting in the creation of a total of 2,630 jobs.
Of the 2,630 new jobs, 1,450 will be at the main Gravata? plant, which builds the Chevrolet Celta and new Onix, another 1,000 will be at suppliers located in the same facility, and 180 will be in the new powertrain facility in Joinville. The time frame that the new shift will be implemented is unclear as of this writing.
General Motors announced the additional shift just after it avoided a strike at another one of its manufacturing facilities in Brazil. The automaker reached an accord late Saturday with the union late Saturday evening at its Sao Jose dos Campos facility, located near the city of Sao Paulo; the development follows the August 2012 agreement between GM and the plant?s union to extended the no-layoff period until January 26, 2013. The avoided layoffs of 1,598 workers would have translated to losing roughly 15,000 jobs in Sao Jose dos Campos, according to the union.
The General recently consolidated its 2009 plan to invest $3 billion in its Brazil operations, with the new plan calling for the development and launch of new Chevrolet products while updating and adding plant capacity. As part of the revised plan, GM invested $1 billion in the Chevy Onix project and expanded capacity from 230,000 to 380,000 vehicles per year at Gravata?. The automaker then invested an additional $172 million to build a new engine and cylinder heads plant at Joinville, where production recently commenced.

HOUSTON -- We?re hearing from one of the victims who was shot last week on the Lone Star College campus. Jody Neal was shot six times. He?s being treated in the intensive care unit at Ben Tab Hospital for his critical injuries.
?I would like to thank everybody praying for me. I appreciate your kind thoughts,? said Neal.
Those words were recorded in his hospital room and played by family members on Wednesday.
Authorities say Trey Foster shot Neal after the two bumped into each other and then argued on campus.
?Jody was shot twice in the stomach, twice in the arm, once in the main artery of his leg, and they found one just recently in his back,? said Sharon Mayo, Neal?s aunt. ?He just had surgery yesterday for that.?
Relatives say a portion of his intestines had to be removed and he could still lose a leg.
Neal claims police treated him more like a suspect than a victim after they saw his tattoos. He denies being associated with any gangs, saying he is trying to get his GED and aspires to be a tattoo artist and graphic designer.

BANGKOK (AP) ? Asian stock markets rose Wednesday after strong U.S. corporate earnings outweighed sagging consumer confidence.
Japan's Nikkei surged 1.7 percent to 11,049.91, its highest level since April 2010, as the yen continued to weaken against the U.S. dollar. Hong Kong's Hang Seng rose 0.8 percent to 23,817.16.
South Korea's Kospi rose 0.5 percent to 1,965.51 after the government said manufacturing output rose 0.8 percent in December from November.
Gains in resource stocks helped lift Australia's S&P/ASX 200 by 0.1 percent to 4,896. Mining giants Rio Tinto Ltd. gained 1.7 percent and BHP Billiton advanced 1.2 percent.
Benchmarks in Singapore, Taiwan, the Philippines and Indonesia rose. Mainland Chinese shares were mixed.
Investors are waiting for the end of a meeting in Washington of the Federal Open Market Committee. That's the group, composed of Fed board members in Washington and regional bank presidents, who meet eight times a year to determine the Federal Reserve's monetary policy including interest rates.
If the Fed sticks to its commitment to low interest rates, that would drive more money toward stock markets, said Linus Yip, a strategist at First Shanghai Securities in Hong Kong.
"The main focus is whether there will be some hints given out about what will be going on in future interest rate moves," Yip said. "Right now, market sentiment remains good."
Last month the Fed said that as long as the inflation outlook is mild, it could keep short-term rates near zero until the unemployment rate dips below 6.5 percent from the current 7.8 percent. That could take until the end of 2015, the Fed predicted.
Meanwhile, a survey on U.S. consumer confidence Tuesday was unexpectedly weak, but analysts said the result was likely a one-time blip due to the payroll tax increase that was part of the agreement reached by U.S. lawmakers to avert bigger spending cuts and tax increases.
Wall Street stocks rose Tuesday after drugmaker Pfizer posted strong earnings. The Dow Jones industrial average rose 0.5 percent to close at 13,954.42 points, ending higher for the seventh day in eight. The Standard & Poor's 500 rose 0.5 percent to 1,507.84. Refinery operator Valero Energy, which also posted strong fourth-quarter results, was the biggest gainer on the S&P.
The Nasdaq composite index was little changed at 3,153.66
Currently, analysts expect fourth-quarter earnings for 2012 to increase by an average of 4.7 percent for S&P 500 companies, according to the latest data from S&P Capital IQ. That's an improvement on the previous quarter when profit grew by 2.4 percent.
Benchmark oil for March delivery was up 5 cents to $97.62 per barrel in electronic trading on the New York Mercantile Exchange. The contract rose $1.13, or 1.2 percent, to close at $97.57 on the Nymex on Tuesday.
In currencies, the euro was steady at $1.3486 from late Tuesday in New York. The euro hit its highest level against the dollar in nearly 14 months Tuesday after data was released showing a rise in German consumer confidence. The dollar rose to 90.93 yen from 90.69 yen.

SNOW CAMP, N.C. ?? An Alamance County man is suing his church, claiming they are at least partially responsible his divorce.
Warren Pegram attended the Quaker church?Cane Creek Meeting of the Society of Friends with his wife. Pegram claims the church plotted against him and members helped his wife actually move out.
?I think the church had a great deal to do with it. I won?t say they?re 100% responsible but they certainly made it happen. I don?t think she could?ve moved out if the church didn?t help her. They provided all the people to move the stuff,? explains Pegram.
Pegram says his wife was responsible for 60% of the household bills. Since she moved out in February, he?s struggled financially.
?They conspired with my wife to abandon me because they wanted to punish me? because I did not want to associate with the relationship with the pastor,? explains Pegram.?
Pegram says the lawsuit isn?t about affection ? it?s about what he calls financial assault.
?I sued them for $180,000 and $10 million in punitive damages because churches should just not do that,? says Pegram.
He said he will not get an attorney because he understands it?s a case not heard too often.
?You have to understand suing a church is not a feather in the cap of any attorney,? says Pegram.
He?s saying his prayers and is confident he will win his case.
FOX8 spoke with the pastor of the church, Mark Tope. He told us over the phone he?s been the pastor for nine years but other than that he had not comment.
The next hearing for the case is scheduled for next week.

Jan. 29, 2013 ? Red flags are easy to recognize in the days following a tragic event like a mass shooting. That's why a group of Iowa State researchers is working to identify those early warning signs in juvenile offenders before they turn into a pattern of criminal behavior.
It is often difficult for people to understand what leads to criminal behavior in children or teens. But by the time a juvenile is arrested, or referred to the juvenile court system, the child generally has displayed a pattern of antisocial behavior, said Matt DeLisi, professor of sociology at Iowa State University.
In some extreme cases, DeLisi said children as young as 5 years old are committing crimes. So when that child becomes an adult, he or she may already have a lengthy criminal record. That is why DeLisi, and the team of researchers, wants to understand what contributes to this behavior in order to correct it.
"With onset in criminal careers, the first sign of that problem behavior is an indicator of how severe it will be," DeLisi said. "If you can help them, you save a ton of money and you save a lot of problems. But it's just the issue of correctly identifying them and that raises a bunch of ethical and other issues."
The connection between the onset and the severity is similar to other ways children start to develop, whether it is positive or negative, at an early age.
"If you have someone who is 3, or even 2, and is already reading it would suggest that the person is highly intelligent," DeLisi said. "The reason is because the emergence or the onset of the behavior is usually inversely related to what they will become. The earlier something appears the more special they are or extreme."
With criminal behavior, the onset begins with rule violations, but researchers found a juvenile's first arrest or contact with the police is the strongest indicator of future problems. The study published in the Journal of Criminal Justice included 252 children living in Pennsylvania juvenile detention centers. The offenders ranged in age from 14-18 and on average had committed 15 delinquent acts in the prior year.
Researchers also discovered that children with attention deficit hyperactivity disorder got into trouble at a younger age than other juvenile offenders without ADHD. In fact, their first contact with police happened more than a year prior to other offenders. Youth with conduct disorder were also more likely to be arrested at a younger age. However, researchers urge caution on how the results are interpreted.
"This by no way means that every child with ADHD or conduct disorder will become delinquent or ultimately be arrested. What it does mean is that future work needs to address why some youth with ADHD or conduct disorder become delinquent and others do not," said Brenda Lohman, an associate professor in human development and family studies at Iowa State.
"From a preventive standpoint, this information could then help identify support systems and intervening mechanisms for families and parents, and ultimately decrease rates of antisocial behaviors of children with ADHD or conduct disorder," Lohman said.
In addition to preventive measures, researchers hope to build on this study to better understand the family dynamics that can lead to mental and behavioral issues in children.
"Extensive research indicates that economic hardship has an adverse effect on the well-being of families," said Tricia Neppl, an assistant professor in human development and family studies at Iowa State.
Economic pressures increase the risk for emotional distress, which Neppl said can lead to harsh disciplinary practices. She is working on a study to determine if such hardships, when a child is between the ages of 3 and 5 years old, impact the child's mental health when they are 6 to 13 years old.
"The results suggest that economic adversity influences parental emotional health, marital distress, and hostile parenting which predicts child mental health disorders, such as conduct disorder and ADHD, during later childhood and early adolescence," Neppl said.
As researchers understand more about the connection with antisocial behavior, DeLisi expects there will be an even greater push for intervention and treatment for ADHD and conduct disorder.
"Early interventions are very successful, but they require a lot of investment on the part of people who may be the least willing or able to invest," DeLisi said. Researchers from the University of Pittsburgh and Saint Louis University also contributed to the study.

WASHINGTON (AP) ? Secretary of Defense nominee Chuck Hagel has told Pentagon officials he plans to divest some of his financial holdings and resign from several corporate boards and public interest groups to avoid potential conflicts of interest if he wins Senate confirmation.
Hagel told Defense Department officials in a letter last week that he would resign his corporate board post at Chevron Corp. and shed investments in the energy firm, a major government contractor. He would also cut ties and investments with the McCarthy Group LLC, an Omaha-based private equity firm.
A new personal financial disclosure filed with the Office of Government Ethics lists Hagel's assets at between $2.8 million and $6 million, according to an Associated Press analysis. Hagel made earnings of more than $1 million last year, including board fees from Deutsche Bank, Zurich Insurance Group and Corsair Capital. Hagel said he would also server ties to those firms.
Hagel's Pentagon nomination has run into heavy fire from conservatives and Republicans who question whether he is sufficiently supportive of Israel. They also question his support for reductions in the nuclear arsenal. Some of his wide-ranging corporate and activist roles have also drawn criticism that his decision-making could be swayed by prior relationships. Hagel's letter to defense officials indicates he is willing to sell off possible conflict holdings and end his directorships to mute those concerns, but would still retain the ability to make his own investments.
In a letter sent last week to Robert Taylor, the Pentagon's acting general counsel, Hagel said that if he wins the defense post, he and his wife would not "invest in any company identified as a Department of Defense contractor or any other entity that would create a conflict of interest with my government duties." Hagel also pledged that if any firm that he has holdings in wins a defense contract, he would sell off those investments.
Some previous nominees for top government positions, such as former Bush administration Treasury Secretary Henry Paulson, have placed their holdings in federally approved blind trusts so that they have no direct role in private investments during their tenure. Others have not used blind trusts because of their minimal investments or their preference to keep control over their holdings. Former Reagan administration Defense Secretary Caspar W. Weinberger was among those who avoided blind trusts.
Sen. John Kerry, President Barack Obama's pick for secretary of state, has holdings worth more than $184 million, and is also not using a blind trust. Most of Kerry's investments are made through family trusts, which limit his direct involvement but are not as segregated as blind trusts qualified by the Office of Government Ethics.
Marie Harf, a White House spokesman, said Hagel worked with the OGE and Pentagon lawyers "to ensure he is in compliance with all applicable ethics laws and regulations." She added that his decision to shed any investments and directorships was "typical protocol."
In his letter, Hagel said he would not participate in any decision that "has a direct and predictable effect on my financial interests" and would request a waiver from the ethics office if he planned any move that could affect him financially.
Hagel's decision to sever his dealings and investments with Chevron were clearly dictated by the firm's extensive dealings with the Pentagon. According to government figures, Chevron received more than $500 million in defense contracts in 2012, ranking 78th among the department's largest corporate beneficiaries.
Hagel joined Chevron's board of directors in 2010 and made $116,000 in fees in 2012. He also has Chevron common stock worth between $100,000 and $250,000 according to his disclosure.
Activists from both the left and right have questioned Chevron's recent involvement with repressive governments, including its plans to develop natural gas reserves in Turkmenistan and its pipeline work in Burma.
One conservative non-profit interest group, the American Future Fund, took aim at Hagel's relationship with Chevron, asking in an attack ad: "How can Chuck Hagel run the Pentagon with so many ethical questions about his own record?"
That broadside came before Hagel's letter outlining his divestment plans. In addition to Hagel's pledge, the Senate Armed Services Committee also has some of the most stringent rules for nominees for senior civilian positions in the Defense Department, requiring nominees to divest all financial interests in any company contracting with the Pentagon. The committee bases its rules on a 330-page list of firms with any Defense contract exceeding $25,000.
Hagel also said he would cut ties to the McCarthy Group, headed by a former campaign treasurer, Michael McCarthy. In 2009, Hagel was named a senior adviser at McCarthy Capital Corporation, a subsidiary of McCarthy's company. The firm's investments include HDR and Vornado, which both have defense contracts.
And Hagel also agreed to step down as an adviser to M.I.C. industries, where he earned $120,000 last year. The firm's business includes making temporary structures under contract for the U.S. military.
His role as a member of Deutsche Bank's America's Advisory Board could also have posed problems because of reports that the German bank was among several global lenders under investigation by the Justice Department for allegedly helping to skirt U.S. trade sanctions on Iran's energy industry. The German-based bank has denied the allegations.

President Obama made an aggressive case for an immediate overhaul of U.S. immigration laws during a speech in Las Vegas Tuesday, giving momentum to the Senate?s new bipartisan push towards reform.
The president declared ?now?s the time? for comprehensive changes to an immigration system he called ?broken?, and which he said has approximately 11 million undocumented workers ?living in the shadows.? He argued getting these immigrants on the right side of the law strengthens our economy.
Speaking in a city that in recent years has been transformed by an influx of Hispanic immigrants, Obama outlined four broad principles he wants in a proposal: Strengthening security at U.S. borders, cracking down on businesses that knowingly hire illegals; streamlining the earned path to citizenship for millions; and improvements in the existing legal immigration system.
?Yesterday, a bipartisan group of senators announced their principles for comprehensive immigration reform, which are very much in line with the principles I?ve proposed and campaigned on for the last few years,? said Obama. ?At this moment, it looks like there?s a genuine desire to get this done soon. And that?s very encouraging.?
But, if lawmakers gets ?bogged down in an endless debate? and don?t act in a timely fashion, Obama threatened to send his own bill to Congress and??insist that they vote on it right away.?
?The closer we get, the more emotional debate this is going to become,? said Obama,?encouraging lawmakers to stay the course, even on this debate which traditionally packs an emotional punch.??It?s important for us to realize that the foundation for bipartisan action is already in place.?
In reaction to the president?s speech, Speaker John Boehner warned a fast hard shift to the left on immigration ideas puts the bill on shaky ground in the GOP-controlled House of Representatives.
?There are a lot of ideas about how best to fix our broken immigration system,? said Boehner spokesman Brendan Buck. ?Any solution should be a bipartisan one, and we hope the president is careful not to drag the debate to the left and ultimately disrupt the difficult work that is ahead in the House and Senate.?
While hailing the Senate?s bipartisan effort?no common occurrence these days?Obama appears to be at odds with the Senate over the specific approach to border security. Similar to the Gang of Eight in the Senate, the president?s preferred method of preventing more illegal immigration and tracking those who have overstayed their visas involves improving infrastructure at processing points and taking advantage of private and public partnerships to encourage technological advances in the way the government processes foreigners to the country.?The Senate?s plan goes one step further, saying increased security measures on the border must go into effect before immigrants can even apply for a green card. A provision in the Senate bill also called for the creation of a border state commission to monitor developments.
Unlike the Senate plan, Obama also figures marriage equality into the equation by giving U.S. citizens and permanent residents the ability to sponsor same-sex partners for visas.
?The president has long believed that Americans with same-sex partners from other countries should not be faced with the painful choice between staying with the person they love or staying in the country they love,? said White House spokesman Jay Carney.
Both sides suggested an ?earned? path to legal status for undocumented workers could include fines, back taxes and background checks. After that, then they could get into the back of the immigration line behind others who have already been waiting to become citizens.
Sen. Chuck Schumer (D-NY) praised Obama?s ?perfect? handling on the delicate situation. ?He is using the bully pulpit to focus the nation?s attention on the urgency of immigration reform and set goals for action on this issue,? said Schumer, who was one of the leaders to submit the immigration proposal. ?But he is also giving lawmakers on both sides the space to form a bipartisan coalition.?

Jan. 29, 2013 ? Getting people to think about morality as a matter of objective facts rather than subjective preferences may lead to improved moral behavior, Boston College researchers report in the Journal of Experimental Social Psychology.
In two experiments, one conducted in-person and the other online, participants were primed to consider a belief in either moral realism (the notion that morals are like facts) or moral antirealism (the belief that morals reflect people's preferences) during a solicitation for a charitable donation. In both experiments, those primed with moral realism pledged to give more money to the charity than those primed with antirealism or those not primed at all.
"There is significant debate about whether morals are processed more like objective facts, like mathematical truths, or more like subjective preferences similar to whether vanilla or chocolate tastes better," said lead researcher Liane Young, assistant professor of psychology at Boston College. "We wanted to explore the impact of these different meta-ethical views on actual behavior."
Ideas have previously been advanced on the subject, but Young and her former research assistant A.J. Durwin, now a law student at Hofstra University, are the first to directly investigate the question.
In one experiment, a street canvasser attempted to solicit donations from passersby for a charity that aids impoverished children. Participants in one set were asked a leading question to prime a belief in moral realism: "Do you agree that some things are just morally right or wrong, good or bad, wherever you happen to be from in the world?" Those in a second set were asked a question to prime belief in moral antirealism: "Do you agree that our morals and values are shaped by our culture and upbringing, so there are no absolute right answers to any moral questions?" Participants in a control set were not asked any priming question.
In this experiment, participants primed with realism were twice as likely to be donors, compared to those primed with antirealism or not primed at all.
A second experiment, conducted online, yielded similar results. Participants asked to donate money to a charity of their choice who were primed with realism reported being willing to give more than those primed with antirealism or not primed at all.
"Priming participants to consider the notion that morals are like facts increased decisions to donate in both experiments, revealing the potential impact of meta-ethical views on everyday decision-making," said Young. "Simply asking participants to consider moral values, as we did with the antirealism prime, did not produce an effect," she said, "so priming morality in general may not necessarily lead to better behavior. Considering the existence of non-negotiable moral facts may have raised the stakes and motivated participants to behave better."
Since "real" moral stakes may be accompanied by "real" consequences -- whether good (e.g., helping others, enhanced self-esteem) or bad (e.g., retribution), priming a belief in moral realism may in fact prompt people to behave better, in line with their existing moral beliefs, the researchers say.
The researchers note that priming a belief in moral realism may enhance moral behavior under certain conditions -- such as when the right thing to do is relatively unambiguous (e.g., it is good to be generous). A different outcome could be possible when subjects are faced with more controversial moral issues, they say.
Liane Young's research frequently focuses on the psychology and neuroscience of moral judgment and behavior. In 2012, she was awarded a Sloan Research Fellowship from the Alfred P. Sloan Foundation, and was named a Dana Neuroscience Scholar by the Dana Foundation, which also awarded her a three-year grant to support her study of brain activity and moral decision-making in individuals with autism, a project that will provide a valuable research opportunity for BC undergraduates. In addition, she received the 2011 Early Career Award for Distinguished Scientific Contributions to Social Neuroscience from the Society for Social Neuroscience, among other honors.
Her research on attributions of responsibility to groups (e.g., corporations) versus members of groups was published in the journal Psychological Science in 2012; she is also co-author of a study of moral judgments in adults with autism that was reported in the Proceedings of the National Academy of Sciences.

NEW DELHI (AP) ? A juvenile court ruled Monday that a suspect in the fatal gang rape of a young woman in New Delhi last month was a juvenile at the time of the attack.
A lawyer present in the court said a magistrate of the Juvenile Justice Board announced the decision after going over documents presented to the court by officials of the suspect's elementary school that indicated that he was under 18 years of age at the time of the Dec. 16 attack.
The lawyer could not be named because he was not authorized to brief media. The lawyer said that the suspect's school documents showed him to be about six months short of his 18th birthday at the time of the attack.
The suspect did not possess a birth certificate ? a common occurrence in India where many babies are born at home and not in a hospital. In such cases, school records are often used as proof of age or identity.
The suspect, who is not being identified by The Associated Press because of his age, could face three years in a reform facility if he is convicted as a juvenile. A conviction as an adult could have led to his execution.
Police say the 23-year-old victim and a male friend boarded the bus on Dec. 16 after seeing an evening movie. But the bus turned out to be off-duty and was being driven by a group of friends who, police say, attacked the couple and then took turns raping the woman. They also penetrated her repeatedly with a metal bar, causing massive internal injuries. The two were eventually dumped on the roadside. The woman died two weeks later in a Singapore hospital.
Meanwhile, a fast-track court was separately hearing arguments Monday in the trial of the five men charged with the attack. Details of the proceedings were not available because of a gag order against revealing what happens inside the courtroom.
The attack set off protests across India and opened a debate about its epidemic of violence against women.
Women say they feel under siege and are so frightened they have structured their entire lives to protect themselves from harassment and attack. Many travel in groups, go out of their homes only during the day and carry sharp objects to stab men who grope them on public buses.
Those who are raped are often blamed by their families for the attack. If they report the crime, the police often refuse to file a report or try to get the victim and attacker to reach a settlement. If it reaches court, the case can drag on for years in the overburdened justice system.

I imagine many readers are burned out from adopting and abandoning New Year?s resolutions, but I?m going to suggest one more: Speak up in class.
A 2012 study by the Yale Women Law Women revealed that:
Men continue to participate more in class than women?and the disparity between male and female participation rates have barely improved over the past ten years.
Faculty and students observe that women seem more risk-adverse in their participation and are more likely to undermine or discount their own comments in class.
Yeah, yeah, you?ve already heard this. But before you reject this advice, think about what lawyers do.
The Model Rules of Professional Conduct describe lawyers? responsibilities as advocating their clients? positions ? whether in court or in negotiations ? or explaining to their clients the implications of relevant law and facts. In a significant majority of cases, the advocacy or the explanations are delivered orally.
You want to be a lawyer? You better get comfortable with public speaking. Not just prepared remarks, but spontaneous descriptions, justifications, defenses and wild-ass strategies. That is what it takes to succeed as a lawyer.
Wouldn?t you rather acquire this skill in law school than babble the first time a partner asks you a question?

BOISE, Idaho (AP) ? An American pastor who has been jailed in Iran since September has been sentenced to eight years in prison, the U.S. State Department said Sunday.
Spokesman Darby Holladay said the department is calling on Iran to respect Saeed Abedini's human rights and release him.
Earlier this month, Iran's semi-official news agency, ISNA, quoted Abedini's attorney, Nasser Sarbazi, as saying his client stood trial in the Revolutionary Court on charges of attempting to undermine state security by creating a network of Christian churches in private homes.
The pastor, who is of Iranian origin but lives in Boise, Idaho, has rejected the charges.
"Mr. Abedini's attorney had only one day (Jan. 21) to present his defense, so we remain deeply concerned about the fairness and transparency of Mr. Abedini's trial," Holladay said.
Following the court presentation, ISNA quoted Sarbazi as saying the court would issue its verdict later, and that Abedini would be allowed to leave Iran and meet his family in the U.S. after posting bail.
"The promise of his release was a lie," said the pastor's wife, Naghmeh. "With today's development, I am devastated for my husband and my family. We must now pursue every effort, turn every rock, and not stop until Saeed is safely on American soil."
Her comments were provided by the Washington-based American Center for Law and Justice, which focuses on constitutional and human rights law around the world. The center is representing the pastor's family in the United States.
Holladay said the State Department is in close contact with Abedini's family and actively engaged in the case. Abedini and his wife have two children.
"We condemn Iran's continued violation of the universal right of freedom of religion," Holladay said.

FRANKFURT (Reuters) - Siemens AG has picked banks to organize the sale of two units as part of its efforts to streamline operations and stay competitive in a weak global economy, people familiar with the matter said.
Goldman Sachs Group Inc will advise the German conglomerate on the sale of its Water Technologies units, while Rothschild will oversee the divestment of its smaller security products arm, which makes access card readers and technology for intruder detection and surveillance, the sources said on Monday.
Siemens, Goldman and Rothschild all declined comment.
Siemens, which ranks as Germany's second-most valuable company and which makes products ranging from trains to hearing aids, late last year announced the plan to divest several units in a bid to focus on its most profitable businesses.
It also aims to put itself in a better position to compete in core product areas with the likes of Switzerland's ABB Ltd and U.S.-based General Electric Co.
Since then, several possible bidders for the water unit - which has annual sales of about 1 billion euros ($1.4 million) and employs 600 - have approached the Munich-based group and investment bankers have started to work on the possible sale, the sources said.

Siemens built up its water technology operations through a flurry of acquisitions over the last decade, buying the water systems and services division of U.S. Filter from Veolia Environnement for instance for $1 billion in 2004.
Since much of Siemens's water business is focused on North America, industry sources expect U.S.-based peers Xylem Inc and Pentair Ltd to take a look at the asset.
"Asian companies are also likely to throw their hats into the ring," one of the people said.
The region is experiencing rapid economic growth, climate change effects, rising populations and stricter energy and water regulations and is therefore expected to see heavy investment in water treatment equipment in coming years, he said.
Kurita Water Industries Ltd, Hyflux Ltd, Hitachi Ltd and Marubeni Corp are seen as possible suitors, he added.
Big private equity groups like KKR & Co LP, Bain and Permira are also expected to show interest.
Permira in 2011 bought Israel-based Netafim, a maker of irrigation technology, for 800 million euros.
Siemens Water Technologies offers products ranging from conventional water treatment to emergency water supply and water disinfection systems.
A report published in 2010 by Global Water Intelligence, an industry journal, put the size of the global water market at more than $500 billion.
Siemens shares were down 0.3 percent by 8.25 a.m, backtracking from a five-month high set last week, compared with a 0.1 percent drop in the main German index.
